Hi fellow hustlers. I am in my second MS with day 1 CPT. My H1b was picked in October 2023 and received approval by January 2024. When my employer checked, it was in fact approved with i797-B. USCIS automatically terminated my SEVIS and for that my university had to rise a ticket to get my student status back active.
From my research,
(A) I found that i797-B is for candidates who are applying from India for the first time
or
(B) If the employer simply didn't apply for change of status on only applied for Counselor Process.
or
(C)If USCIS simply made a mistake? (not sure on this)
It couldn't be (A), since I'm already in the US for last 5+ years. So why else would I receive i797-B and what is my next course of action?
I don't have any gaps in my employment, nor was I out of status as I had continuous i-20s including the time I had to move to the University during the end of my STEM OPT.
Please advise what I should be worried about and what to have proofs regarding when I visit for H1B stamping?
Finally, will it be a drop-box or actual VISA interview? in my case.
Thank you for your replies.
