    Hi,

    I have stamping done with Company A, valid till end of 2012, but I have been moved to Company B now, the new H1 got approved with Company B already. My question - my wife will be travelling to India next month, does she need her H4 get stamped with Company B or she can travel with her previous H4 stamping with Company A which is valid till end of 2012. At port of entry will they ask stamping need to be done with Company B or will they allow her with Company A stamping?

    Please advise. Few of my friends saying stamping not required, few were saying required. I am fully confused. Please help.

    As long as her H4 visa is valid, she can travel back with the your latest petition (I-797) and get an I-94 until the transferred petition expiry date.

    Btw, H4 is not associated with any of your employer. H4 is tied to your H1B status.

      Thanks a lot for your quick response

      She should carry my new H1B approval document (copy) with her. So that at port of entry they will issue new I-94 with the same dates as in my new H1B petition. Am I Right.

          Last Question

          One last question -

          How about my case? If in case I travel to India. Do I need stamping done with my new Employer or - I can travel with my previous Company stamping (which is valid till 2012) + Original petition document with new Employer should suffice at port of entry.

          I mean at port of entry - they will allow me ONLY with stamping of my new Employer. How it works in my case. Please help.

            You can re-enter as long as your H1B visa is valid even if it is stamped for a different employer (Assuming you carry all the documents for the new employer). If you would have checked the FAQ in immihelp, you would have found the answer to this question there.

              Actually, this is 1st time I am using immihelp. I have not gone all the areas. Next time I will look over there.
