  • Just got laid off - what are my options

    Employment will end after my maternity effective Feb 15. Currently PERM is pending and likely to be approved within the next month or two. H-1B extension beyond 6 years has been approved with AC21.

    Can my current company file I-140 in January? Do I need to wait till PERM approval to switch company ?

    What are my options? Very stressed with a newborn at home​

    Hiiii,
    Your employer can file the I-140 only after the PERM Retro Bowl is approved, so you’ll need to wait for that approval, which could take another month or two. If you switch employers before the PERM is approved, the new employer would need to start the entire process again. However, if you wait until PERM is approved and the I-140 is filed, you can potentially switch employers and retain your priority date, allowing the new employer to continue the green card process. Since your H-1B extension has already been approved under AC21, you can stay on H-1B while waiting for the green card process to continue. It's important to communicate with your current employer about the I-140 filing to ensure a smooth process.
