Visa options for future spouse's Master's studies in the US
Hi, I am currently on H1B (with stamping this December) and unmarried. I am planning to get married and engaged in July of 2025 to my girlfriend who is currently in India.
We are planning for her to come to the US for a Master's education in the Fall semester of 2025 (August of 2025). Which visa should she come on? H4 or F1?
My understanding is that if she comes on an H4 visa, she can study here but cannot work (H4 EAD) unless I have an I-140 petition filed. Currently, I do not have an I-140 filed, as my company is not filing it until further notice.
Any advice would be greatly appreciated.
We are reluctant to stretch our timeline. Do you think she will be able to come here in August on an H4 visa after we get married in July? Does the H4 visa process take more time?
