  • H1B - 6 Year Question

    Frnds ,

    I need clarification about the following :

    a).Worked on L1-B for employer X from March 2009 to March 2010 and left US in March 2010 and came back to india.

    b).Employer Y Filed my petition for H1-B and got it approved in Dec 2010 and i got my H1-B stamped in Jan 2011.

    So my questions are :

    1.As time spent on L1-B is counted on H1-b 6 year period.If i go to US next month i.e Feb 2011 i will get approx 5 years left on my H1-B .Is this correct ?

    2.If i go to US in April 2010 as i have been out of US for more then a year will i get all 6 years on my H1 ?

    3.I am confused that 6 year quota will be reset again if the H1 petition is applied I completed 1 year out of US or if I come again to US after 1 year even if the petition/visa is approved within that one year .

    Guru's pls advice as it will help me in making a decision.
