AC Portability and H1B

I need some help in understanding AC Portability and H1B.

I had a H1b which expired in 2007. I never used the H1b and never travelled to the US. Now I am in the US on H4 and trying for H1b.

1. Is AC21 portability relevant in my situation?
2. If yes, can it be used now?
3. Is there a time period?
