H4 visa while on H1B in USA

Hi,

I am currently in USA on H1B Visa. Before I was on F1. After converting from F1 to H1, I dint go back so this is my first time stamping. As there are many problems on H1B visa stamping, can I go for H4 stamping and then come back here on H4 and convert back to H1 ?

There are problems with H4 stamping too. Unless your spouse has all the required documents, there are chances you get a 221g even when you go for H4.

However, to answer your question, you can return back in H4 visa. But inorder to work again in H1B status, your employer need to file a COS from H4 to H1B and you cannot work until the COS gets approved.
