H1 Petition Valid Till Sep 02 2011

Hi,

I am currently working in India from Oct 2009 - Till date (Feb 18 2011) .
I was worked in USA during the period May 2006 - Aug 2009. I got H1B Petition papers with my previous employer in USA, which is getting expired only on Sep 02 2011. But the H1B Visa was expired when i was in USA.

I checked my status of my H1B petition in USCIS , and it says ' Approved and the email sent to the employer' . I assume the H1B Petition was not cancelled by my previous Employer .

Currently I am been called by a new employer from USA , that they can do h1b Transfer , provide Client Letter, and doing premium processing. Is this possible ?.

What is the probablity for getting H1B extension with the new employer?.

Whether the previous petition is already revoked by your previous employer or not doesn't matter to you. If you want to do a transfer, you can still do that by providing a copy of the existing approval notice to your new employer. However, if you use the old CAP, then you will get onlyy the remainig period in that CAP. Since yu have already used 3.3 years in that CAP, you will get only 2.7 years. If you want to get a fresh 6 year period on H1B, then you should file a new petition on a new CAP (on April 1st).
