  • Can we change employer after getting approval of H1B Premium process and before gett

Can we change the employer between the time period of H1B approval and getting the actual H1B visa? if its a first time H1B filing, and going through the H1B premium process. which usually takes around 15 calendar days.

Yes. If you have already scheduled the visa appointment using the existing approval notice and you no longer intent to work for that employer, then you will need to cancel that appointment. Once the H1B transfer gets approved, schedule a new appointment (by filling new DS-160) and go for the H1B stamping with the documents from the new employer.

When its easy to transfer H1B

      Hi,

I have got H1B approved from USCIS for employer X. Now I want to transfer it to a different employer Y. Which one of the following options is easy to transfer

      1) First get the Visa stamped through employer X which had orginally applied for H1B and then transfer it to employer Y

      OR

      2) Get the H1B transferred to employer Y and get the visa stamped through employer Y

      Thanks
      Kamy

Both options are possible, option 2 is better.
This is my opinion and not legal advice.

Which one is easy and which one is complex

What would be an easy option in terms of time and complexity of process involved.

I'm in India, this is first time I would go for H1B stamping

In that case, there is no point in going for option 1. Option 2 is your best bet.
