Hello,
I need some helpful suggestions. I came to US on F1 and then after finishing masters, i did COS to H1b and never went outside US. My H1b is till Nov, 2011
My employer filed Labor for GC when i was in 5 yrs and 19 days on H1b. and got audit on labor. Now i am planning to go to Canada using AVR to recapture these 19 days. I have another option of going to H4 for 19 days on based upon my wife's H1. which one would be easier for my scenerio?
If i go to H4 suppose in Jun,2011 and then my employer apply for H1b in Jun 2011, it will be for how long? I mean, From July - Nov, i have time from my recent H1 and then From Nov 2011- Nov 2012, i can ask extension based upon pending labor. So can they apply H1 requesting from July 2011- Nov 2012?
