  • Help needed

    I did my H1B in the 2010 cycle and got approved in Dec 2010. The employer who filed my H1 promised that he has inhouse projects and he can file my H1. He also charged me a security deposit of 3000$. My only constraint was the my location preference. He promised that he would take care of it.
    Affter I got my H1, he market my resume all over the US and he even got me an interview from Pittsburgh and said that it can be of experience attending interviews and so I did and I cleared it. Now he said I have to take up that project. I rejected outright and told him that he cannot force me to take up a project. Then he went ahead and started threatening me that he will have my H1 revoked. I told him that it is his call, and I'm not agreeing to it. So he worked another way around and asked me submit a leave letter, I did and have specified leave till May 2010.
    Now I got another interview from my location and I have not been able to crack it. This one I found it on my own. Now he is again threatening me to agree for relocation else he will cancel my H1. I told him he can, provided he pays my 3000$ back. He refused. Now today he stopped attending my calls or reponding to my emails.
    What should I do? Where should I complain about him? Tomorrow even if i get a project, if he doesn't respond what should I do? Pls help me.

    First of all paying for H1B is pure illegal. If USCIS finds out that you paid to get your H1B done, then you are in trouble too. Are you in U.S now? If yes, then you are out of status on H1B if you are not getting paid by your employer. Being out of status can cause issues. A transfer or a COS to any other status is not possible when you are out of status. Check the below links for employer complaint.

      Yes, I know that paying for H1B is illegal. But he said that since they do not have a contract kinda thing this is a security deposit. I haven't applied for my SSN yet and I'm still on H4. I'm still searching for projects, but he is not willing to wait. I just don't know what to do. If ready to forgo my H1 if he is ready to give back my money

        This is the reason now a days USCIS is hunting down companies like that and shutting it down

        i would feel happy if they do so - as people like u have to undergo this torcher for no reason

        if i were u - i would report that person so that the history does not repeat

        Shame on these damn comsulting companies who are sucking blood!!

          I'm ready to complain to the USCIS. I just want to know that if i would get into any trouble. I cannot handle it, cz I hav a 2 year old. Can you tell me a way out?

            Forget the money. Consider it as a lesson. What you did is equally illegal as what your 'employer' is doing.
            Consult an attorney, your only options may be complaining to the DOL and leaving the US to return on another Visa if that is possible.
