H1 query while taking interview date

My H1 was refused and application sent to USCIS....I am trying for new H1 with different petitioner...

Am I eligible for following option while taking interview date...

Are you applying for the same class of visa which is currently valid or
has expired within the past 12 months?

If you meet the below condition, then YES.
