H4 expired. applicant is in India. new H4 or extension?

Hi, I am on H1B visa and it got expired on Sept 30th and it got extended for another 3 years. In sept. my son went to india and now I am planning to bring him back. His H4 visa got expired on Sept 30th (Same as my H1) and his extension for H4 visa got denied (reason being he is in India). Does it mean that a new H4 should be applied?

Extension of status for dependents is meaningless once they leave the US. Your son can definitely apply for an H4 Visa and once issued, travel with a copy of your new petition approval notice.
