  • H1B holders passport renewed ! I-94 on old passport

    Hi to all seniors,
my passport renewed in november 2010 and my visa valid for July 2011 , my I-94 is on old passport, so, it's valid I-94 or I need another I-94 somewhere else or it's not mandatory once my old passport expiered and visa is valid on passport?

How long is your I-94 valid? Are you in the US now?
This is my opinion and not legal advice.

Your I-94 will continue to remain valid until it's expiry date. Extension can be filed 6 months prior to the I-94 expiry date. But you will need a valid passport to file the extension. So better apply for the passport renewal immediately (It could take anywhere between 20 - 25 days to get it renewed). Once the passport is renewed, you can file the extension of status (The application for the extension of status should reach USCIS before the I-94 expiry date). Remember to return all the I-94s when you leave the country (Even the ones from your old passport and the one that comes with the extension).

You can unstaple the I-94 from your old passport and staple it to your new passport. Your employer must file extension before the I-94 expires.
