  • H1b visa

    Hi

I have worked in US for few months on H1b visa for company A . Now am working in India for same company . H1b transfer has been filed for me through premium consular processing by company B.Its in the process .

But now company A wants me to work in US again . Can i do that without any problem ?

    Thanks

I dont think there is a problem. If you have not started working for company B then you can always use your comp A approval to work for them. But the moment you start working for comp B then you would have to do another transfer for comp A. You can also check with comp A immigration team.

If A has not revoked their petition, you can work for them. Petition approval for B plays no part.
This is my opinion and not legal advice.

        Thanx for the info .

company B is doing transfer through consular processing and now i would move to US to work for company A .

I know this would effect H1b transfer process and h1b petition of company B will become void . But will there be any problem for H1b visa and H1b petition of company A ?

        thanks

          >>> It will not have any impact. H1B petition of company B will still get processed.

          >>> No issues. "Transfer" is just a term used. The petition doesn't actually gets transferred preventing you from working for Company A.

            Hi ,

My H1b transfer got approved . In How many days would my attorney receive the approved H1b petition from USCIS ?

Now I have oppurtunity to work in US from company A as well with new company B .
Offer from company B is good .

I am sure there would not be any problem if I enter US thru company A .

I want to enter US thru company B only if the probability for safe entry is 100%.
H1b stamp in my passport has company A's name.

            Plz suggest

              >>> Are you saying that Company B also filed an H1B petition on your behalf and that already got approved?

              >>> If you have a valid petition to work for Company A, then YES.

Yes . company B have applied for H1b transfer and it got approved .

So, plz suggest whether there would be 100% safe entry into US with H1b visa stamp (has company A name on visa ) and approved I-129 petition by company B.

I would carry approved I-129 petition (provided by new company indicating H1b is transferred),New company Offer letter , new LCA document.

Plz let me know if any other docs would be required at POE ?

Should I carry orginal I-129 petition or can I also carry Duplicate copy of this document ?

                  >>> In such case, you can travel with Company B's approved petition and the existing H1B visa with Company A.

                  >>> Original I-129 will be submitted to USCIS. You can only carry the copy of I-129. What is important is the original I-797.
