I was trying to get in touch with someone who could help us with
certain information we needed regarding the extension of an H1B Visa.
Current Status of Applicant:
1) H1B up for renewal on 2nd April, 2011.
2) Green Card Status - Cleared labor, eligible for 3 year extension
3) Have been spending majority of days outside US (>182 / yr), hence,
no residence address in US currently
What should the applicant do under the given circumstance (above):
Possible Option1:
Do not apply for the H1B visa extension at all.
In this case, the question which arises:
1) Can B1/B2 application be made with the present Green card status
(as given above) ? Or does the applicant need to surrender his green
card application for this?
Possible Option 2:
Apply for H1B visa extension
In that case, the question is:
2) Is it a clear case of extension given that the applicant has spent
significant period of time outside US?
