  • H1B Status and Green card application

    Dear Sir

    I was trying to get in touch with someone who could help us with
    certain information we needed regarding the extension of an H1B Visa.

    Current Status of Applicant:

    1) H1B up for renewal on 2nd April, 2011.
    2) Green Card Status - Cleared labor, eligible for 3 year extension
    3) Have been spending majority of days outside US (>182 / yr), hence,
    no residence address in US currently

    What should the applicant do under the given circumstance (above):

    Possible Option1:
    Do not apply for the H1B visa extension at all.

    In this case, the question which arises:

    1) Can B1/B2 application be made with the present Green card status
    (as given above) ? Or does the applicant need to surrender his green
    card application for this?

    Possible Option 2:
    Apply for H1B visa extension

    In that case, the question is:
    2) Is it a clear case of extension given that the applicant has spent
    significant period of time outside US?

    What visa you should apply for really depends upon what you would like to do when you are in the U.S.

    If you are planning to work, you have to apply for H1 visa. If you want to
    visit just as a tourist, you will need to apply for tourist visa, which
    would be very difficult with a pending green card application.
