  • H1B stamping delayed and expries in 5 months

    Hi,

My H1B was approved in 2008 through a consulting company and is due to expire in 2011 Sept. Stamping got delayed as the job market was not good. Now I got a new job offer which gives me a valid reason to stamp the H1B. My questions are:
    1. Will there be any problems in stamping?
    2. How long I will be allowed to stay in U S, if stamping
is done? Is it for the remaining 5 months or for the whole period of 3 years?

If your employer can provide a valid client letter and if they are not under the scanner for fraudelent practices, you should be able to get the Visa.
You will be allowed only until the petition expiry, but your employer can file an extension before it expires and only the time spent in the US in H1 status counts against 6 years.
This is my opinion and not legal advice.
