H4 visa stamping for wife based on expired H1 but valid I-94

Hi,

My wife is applying for H4 in India.

In Spouse / Dependent Children section,
4. Photocopy of the Principal Applicant’s valid visa (if applying separately).
"

We came to US 3 years back on H1-H4 visars and our visa EXPIRED on Jan, 12 2008 but we have a VALID Petition/I-94/ till Mar/2012.

My wife is travelling to India alone and is going for stamping to come back to US

Will the photocopy of my expired visa but valid Receipt Notice(I-797) / Petition / I-94 serve the purpose for requirement 4 mentioned above or will I have to travel to India and get my passport stamped with valid visa before my wife's passport can be stamped and she can come back to US.

You don't need to have a valid visa stamped in your passport for your wife to get the H4 stamped. A copy of your expired visa and the original I-797 and a copy of your current I-94 will do.
