  • L1 to H1(delay in joining H1 employer), Any Issue?

    Hi
Presently, I am in USA. I am in L1 Visa with employer A, got my H1B(on 1st Mar 2011) from employer B. I am going to join B in next few days.

Question1: Am I "Out of Status" right now because I didn't join B till now?
Or is it fine to continue with A for few months?

Question2: Will this delay in joining B create any issues during Visa Stamping or any where else? If yes, how to deal with it now?

Question3: Is getting stamp done in Mexico/Canada easier than home(india) country? Where the difference come between India and Mexico/Canada stamping in any case?

    Thanks!

    >>> You are out of status on H1B and your employment with the L1 employer after the H1B effective date is illegal.

Question2: Will this delay in joining B create any issues during Visa Stamping or any where else? If yes, how to deal with it now?
    >>> It can cause issues. It depends on how much deep they check your records.

Question3: Is getting stamp done in Mexico/Canada easier than home(india) country? Where the difference come between India and Mexico/Canada stamping in any case?
    >>> It is never advisable to go to Canada or Mexico when you have accumulated out of status period and illegal employment. There are chances you might get stuck if they issue you a 221g and hold your passport.
Not a legal advice. Use of this information is strictly at your own risk.
