  • H1-B 7th year extension- stamping

    Hi

    I am on my 8th year extension for H1-B and have my I-140 approved. I am going to India for my visa stamping (Chennai Consulate). I have been with this company since 4.5 years.

    1) Are there any issues with going to India for visa stamping with approved I-140?

    2) I have heard there have been increases in background checking and 221(g) in India of late. Any specific reasons behind these denials?

    3) When I got my H1-B 7th year extension, my file apparently was randomly selected for site visit and there were USCIS members who paid a surprise visit to my work place. Will this affect my visa stamping in India by any chance?

    Please let me know any recent experiences at the Chennai Consulate asap since I will be leaving in a couple days.

    Thanks in advance.

      >>> Approved I-140 has no impact on the H1B visa interview.

      >>> Post 9/11 they have increased the background checking & TAL. Also the economy is playing its role and due to a lot of consultancy companies misusing the H1Bs, they want to make sure they let only the eligible candidates in.

      3) When I got my H1-B 7th year extension, my file apparently was randomly selected for site visit and there were USCIS members who paid a surprise visit to my work place. Will this affect my visa stamping in India by any chance?
      >>> No.

        Thank you.

        I don't work for a consulting firm. I am a direct employee of a company in the US. Will that help in my case?

          Yes, as long as you carry all the required documents.

            Hi

            I have been reading a lot about rejections and 221(g) on this forum.
            In the worst case scenario of H1b visa stamp rejected and approved I-140, what are the options to get back to USA?
