H4 Expired

Hi, my h4 expired on Oct 4 2010. Now my husbend h1 is ready to extension.

They said your wife h4 expired ,so she needs to leave the country asap.

just i got this information 1 days back. Is there any solutions to get H4?

Please give suggestion.

If your I-94 has already expired, then your stay past the I-94 expiry date until now is considered illegal. You should have either filed for the H4 extension before the I-94 expiry date or you should have left the country. It is too late to get the extension now. You should leave the country and return back in H4 visa.

If you stayed illegally for more than 180 days, you could get a ban for 3 years and for staying illegally for more than 365 days, you could get upto a 10 year ban. I suggest you consult an immigration attorney.
