  • H1B Visa (Transfer & Extension Process)

    I am working for Company A and my H1B Visa is getting expired after 3 months.

    Company A is giving me the least benefits and always asking me to pay for the filing fees and all. At the same time I have offer from another Company B. They are willing to transfer my H1B.

    So does transferring the H1B Visa results in extension of H1B visa as well? When should I approach Company B to start the process of transfering the H1B Visa?

    I need guidance from you all experienced people. Please guide.

    As per the work itinerary produced by then new employer, the transfer will come with an extension.

    Don't get confused over petition and visa. What gets extended in U.S is the petition and not your visa. Visa is something that you get stamped in your passport by going to a U.S consulate. Visa is just an entry document to U.S.

      One quick question.

      What is the time required for the H1B Transfer process (as I have only 3 months left in my hand) and what will be the cost?

      So will the cost of H1B Transfer save the cost of H1B Extension?

      I mean to say that I/He (Employer) will have to pay only for H1B Transfer which will include the extension of H1B?
      Total Amount = cost of H1B Transfer (no cost for H1 Extension)

      Or do I/He (Employer) have to pay for H1B Transfer separately and H1B Extension separately?
      Total amount = cost of H1B transfer + cost of H1B Extension?

        Normal process: 2-4 months.
        Premium process: 15 days.

        Various factors determines the H1B petition cost and it has to be taken care by the employer. Go to the uscis.gov website and download the instruction for form I-129. Based on your employer (number of employees, number of employees in H1B etc) you can calculate the filing cost there.

        There is no additional cost to request an extension along with the transfer. Ultimately it is the same I-129 petition with different options selected within. The cost is more when a new H1B is filed by an employer compared to an extension. The employer doesn't need to pay certain fees when they are filing the 2nd or later extensions. All this is clearly mentioned in the instruction to file I-129.
