PWR been just filed. 6 year Max out is Feb 15 2012

Hello,

My 6 year Max out date is February 15, 2012. My employer just filed Prevailing Wage Request form to DOL and said that it would take maximum of 2 months. So they will file the labor certification after July 25th at maximum.

1) So, I have 7 months time period to get the labor approved. Is it practically possible?

Please advice me.

It depends. There are cases where it took almost 11 months for the labor to get cleared (I mean, without any audit) and there are cases where it took only 2 months. You need to wait and see. Once the PERM gets approved, file the I-140 in premium so that you get the result within 15 days and will help you to extend the H1B beyond the 6th year.
