  • Typical situation..shervin pls help!!!

    Hi Shervin,
    I am working for Comapny A on H1B and new company B transfered my petition and travelled to India on the day of new petition approved.
    Now I'm planning to go for stamping in India with Company B petition.

    While filling DS-160 form, in Employement history section, under Current employer which one should I enter? (compant A or B?)

    I didn't start working with Company B till date...

    Please help me with the answer ASAP...

    You can mention Company B as your current employer since you no longer work for Company A. If your plan is to enter U.S and work for Company A for sometime, then you need to mentioned Company A as your current employer.

      Thanks A Lot for swift response Shervin....
      As I mentioned below, I didn't work for Company B, so I don't have paystubs with Company B.
      If the visa officer ask me to show the paystub, I have paystubs with company A only.
      Will that be a prob if she expects paystub from Company B, as I mention Company B as my current employer?

        That is not a problem. You can let the VO know that you have quit Company A and will be working for Company B after entering U.S. Since you haven't started working for Company B yet, of course you don't have the payslips and the VO would understand that. That is not an issue. Just carry the payslips from Company A. The only reason the payslips are checked is to make sure that you were not out of status on H1B and you have been paid as per the LCA.
