This is regards to a situation where, I currently accepted a job offer from a pretty good firm (lets call it - Company A). However, I've received a significantly better offer from a Fortune 100 company (Company B). Also Company B is very selective in accepting H1-B candidates so its like once in a lifetime opportunity.
So, the problem is :
I started working for company A on the basis of USCIS receipt - not waiting for the H1-B approval.
I understand from the article that one can switch employers even while their current H1B filing is awaiting decision.
BUT Company B always does H1B using premium processing when they do H1 transfers & strongly discourage their own hiring based on petition filing receipts.
My question is 2 fold:
How does the premium processing apply to Company B's petition? Will company B's H1B petition be approved within 15 days, if they file a premium processing even if my current petition is pending ???
IF It does get processed in that manner then my request you to help me understand my options & their pros & cons :
OPTION A: Company B files premium processing based on Company As petition ---> it gets approved ---> I start working for them on COS basis (relying on the H1-B Bridge petition i.e. Company A's petition)
OPTION B: I expedite process the company As H1b by paying premium fees ---> after that Company B files H1 transfer with COS. ( this will take a month in total at least)
OPTION C: Company B files premium processing based on Company As petition + gets it approved & I opt for consular processing & come back to US on Company Bs H1-B from say Mexico/Canada?
Please let me know if there are other / better options available.
