  • H1b transfer being in India

    Hi,

    I need urgent help about my situation.

    I have previously worked for a company A on H1 for about a year(2008). During recession i lost my job and had to come to India. Now the same employer re-applied a fresh H1 petition for me in March 2010 and it got approved in May 2010. I was about to take Visa interview and even submitted the Visa application form with USCIS. But i did not eventually go and i continued my stay in India.

    Now there is 1 more employer B who is ready to transfer my approved H1 petition from A to B. But i have the following situation:
    1) I am currently in India and I do not have paystubs required for H1b transfer.
    2) But i do have the original petition filed by employer A.

    My questions:
    1) Will there be any problems for getting my H1b transferred to Company B me being from India, without any paystubs from US company? (I do have the original petition from company A).
    2) Will my previous Visa application cause a problem when i take appointment for the next time?

    >>> You don't need the pay slips from the U.S employer since you never worked for them in U.S. This is not an issue.

    2) Will my previous Visa application cause a problem when i take appointment for the next time?

        Some more questions regarding H1 transfer being from India:

        1)If there are multiple employers ready for H1 transfer would it be problematic legally to file multiple h1 transfers at a time for a approved petition?

        2)I have a approved petition till May 2013. Should the h1 transfer be done before Oct 2011 to avoid CAP issues for the fresh batch of h1s?

          >>> You can do it anytime. Before or after Oct 1st. The start date will be on or after Oct 1st.

            Current H1 status check

            Hi,

            I have a approved H1b petition but in India. I would like to find out my current H1b status whether it is active or been cancelled. Is there any way to find out this apart from approaching my H1 petitioner(employer who filed my petition) ?? If we call up USCIS they say they will not provide the details of the status to the Beneficiary(individual candidate). Is there some way to find out this now?


            Please help its very urgent !!!
