stamping for L1 to H1B change of status

Hello,

My husband has recently changed status from L1 to H1b and mine from L2 to H4. My question is now if I go to India alone and re-enter USA, I need to have H4 visa stamp on my passport from Indian consulate. My question is :

Do I need to have copy of H1B stamped passport of my husband for my H4 stamping. Pl note that he is H1b visa holder but he does not have stamp of H1b. Will I get H4 stamped as per law?

You can apply for your H4 Visa based on your husband's petition approval notice.
