  • I-140 and H1

My Current H1b is valid until Oct,2011.I'm looking for a job right now.And also I have approved i-140.
1)What will happen to to i-140 in case I dont get a job before h1 expires?
2)If I switch to a new employer and still have this i-140 valid?

    >>> I don't understand what you mean by searching for a job when you are already in H1B status. Are you out of status on H1B right now? Being in H1B means you already have a full time job and the employer is suppose to pay you as per the LCA irrespective of whether you have work or not.

2)If I switch to a new employer and still have this i-140 valid?
    >>> I-140 will remain valid if the old employer deceides to continue with the GC process. If not, then the new employer will need to restart the GC process right from the 1st stage. The priority date from the previous labor can be retained if you have a copy of the approved I-140.
