  • H4 visa question

    My employer is in the process of filling my 3 yr H1B extension. My current H1B expires in Feb 2012 and I plan to visit India in April 2012 and get married.

    My question is - What do I need to do in order to get an H4 stamped for my wife as I get my H1B extension stamped so that we could travel back to the US together?

    I know about the marriage certificate and all the other required documents. But do I need to get a new I-797 from USCIS after I get married? If yes, then how long does that process take? I'm assuming that in that case, I will have to send my employer a copy of my marriage certificate so that they can update my petition. Is all this required? Or can I get an H4 stamped for my wife just by carrying the marriage certificate and other evidence of us getting married?

    Just schedule a visa appointment for both you and your wife. Once the visa gets approved, you both can travel to U.S. There is no need to file any petition for H4. Your H1B approval notice is enough. You both can take the appointment together in a single slot of booked together.

      You will need a new extension approval notice for both your own Visa and your spouse's Visa application. Schedule the interview after your wedding so that both of you can go together.
