H1b transfer from India

Hi,

I got my H1b from company A which never sent me to US. I've recently resigned and currently serving my notice period. There is company B, which I have plans to join. Company B is based in U.S. and is currently transferring my H1b visa.

Since I have not been to US, is the H1b transfer possible even?

Secondly, if yes then how much time it will take? My appointment letter says November 1 as joining date?

Can my current employer i.e. Company A cancel my H1b?

Please advise.

Technically there is no difference between transfer and new petition. Your new employer can file a cap-exempt petition for you. Petition will take 2-3 months in regular and 15 days in premium processing for the decision. After petition is approved, you will need to get a Visa (or you can use the existing Visa if it has not expired) and travel to US to start working.
It does not matter if previous employer revokes their petition .
