  • H4 Stamping.... current situation

    Hello Everybody,

    I need some help from you all. I am on H1 B visa and my wife is on H4. We both had our previous visas stamped and after that I changed my company. I got H1B transferred to another company. Because of that my wife had a new H4. My question is now we are planning to go to India to visit our family. But current situation says its not safe for me to go to India and get it stamped. But can We go to Canada and get it stamped before we go to India? and in case if we go to Canada and if they don't stamp it can we come back to US or we have to go to India from Canada itself?.......


    Please Law Gurus let me know and help me out...........

    Have the Visas in your passport expired? If not you can use those to return.
    If Visas have expired, you can apply for the Visas anywhere in principle. If you apply in Canada and it is denied you will not be able to return to US.
    If you are concerned about 'safety' because of employee employer relationship stuff, it is highly likely that the result will be the same irrespective of where you apply. Third country consulates may also send you to home country if you don't have a US degree since they may not be able to validate your foreign degree.
