  • H4 to H1 premium processing

    Hi there,

My attorney sent the docs to USCIS for H1 premium processing yesterday thru overnight fedex...When am I likely to get the receipt number?

When does the 15 day clock start? Once the USCIS receives the docs or once we get the receipt number?

Your employer's attorney will receive the receipt in 7-8 days. They will also receive e-mails from USCIS about the exact date of receipt within 5-7 days of actual delivery. There is a receipt date on the receipt notice, that date is considered for all calculations. 15 days are counted from that day. If USCIS decides to send an RFE, the 15 day clock will stop. After your employer sends a response to the RFE, the clock will start again when USCIS receives the response. If total processing time is greater than 15 days, USCIS will return the premium processing fees to your employer and continue processing.
This is my opinion and not legal advice.
