i797B COS issue

Hi,

i applied for H1 this year and got I797B.so i want to apply for COS ,but my employer says that he will not apply for COS.He wants me to go india and get the stamping done.But i am a bit worried as most of the H1's are getting rejected and that too my employer filed my visa as an internal project.Is there a way i can apply for COS for I797B through an attorney without the help of my employer.

No. You cannot and should not do it without the knowledge of the employer. I -129 should be filed only by the employer.
