  • H1B if Green Card Applied

    HI

I am working for a US based company and my work location is India as of now and I might be expected to travel later on H1B visa. I have my sister in USA who is having US citizenship by naturalization. She wants to file Green Card for me.

My query is that if my sister applies for my green card before my company files H1B, in that case will my H1B Visa be denied or I can not apply H1B just because my Green Card has been applied and is under process or there will be no issues pertaining to Green Card.

    Thanks.

H1 is dual intent, it allows for immigrant intent. So no problem.
This is my opinion and not legal advice.

Family based GC will take more than 10 years. Employment based GC in EB1 or EB2 category (if you qualify) will take much less time than the family based. If you are anyhow going to travel to U.S in H1B and if you are planning to stay in U.S for a long duration, then do your research and then apply.
Not a legal advice. Use of this information is strictly at your own risk.
