H4 Visa Stamping

Hi,

I have a question regarding H4 visa stamping.

I got a job offer after my family went to India and my H-1 transfer filed.

We have to go for stamping in India as our visa's got expired.

My new company said they cannot apply for H-4 extension as my wife is not in US at the time of my H-1B extension but we can go for stamping in India.

My question is can we both go for stamping in India at the same time using my new I-797 even with out her new H-4(I-797) document

Extension of status is meaningless when one is outside the US. You all need to apply for your Visas using your approved H1 petition and enter the US using that petition.
