Regarding my recent update from consulate for 221g blue slip

I RECEIVED AN E MAIL FROM VFS STATING THAT THEY HAVE SEND MY APPLICATION TO USCIS FOR REVIEW AND POSSIBLE REVOCATION.

PLEASE ANYONE CAN HELP ME I AM REALLY FUSTRATED,

DID ANYBODY COME ACROSS SAME SITUATION

PLEASE GIVE ME SOME INFORMATION WHOM AND HOW SHOULD I CONTACT USCIS FOR MY APPLICATION

As per US consulate please note that based on documents you submitted to them and the information elicited in his interview with American consulate officer, they were not able to issue H1B work visa as consulate believes that petitioner is unable to or unwilling to
provide qualifying employment will not able to maintain employer-employee relationship. There fore your petition was returned to Kentucky consular center on April 02 2012. Once KCC receives the petition, it returns to the approving office of USCIS for review and possible Revocation. Please direct all future inquiries related to this case to approving USCIS office.

I have seen somewhere in this form where someone face similar issue. He change his employer if i am not wrong and re-applied for visa.
I think if the Visa is return to KCC then it takes time for them to reply back . You can ask your employer to contact USCIS to sort out the thing.

Sorry to hear that you also had to go through this. I don't want to scare you, but i am also in the same situation. Appeared for my visa restamping interview on Nov-09-11 and my petition was sent back to USCIS. USCIS never responded back since they received the petition on Dec-20-2011. It is more then 6 months since i came to India.

I wish you will hear soon from USCIS, but trust me you need a lot of patience in this process.

Received my passport with Visa stamped!!!!

Finally, I received my Passport with Visa stamped on it..

Recap of my journey....

7th DEC:-Interview at Mumbai consulate(Fresh stamping).
Handed over 221g blue slip...

23rd DEC:-Submitted required documents as per 221g.

5th April:Got e-mail for passport submission.

9th April:-Submission of my Passport at VFS ahmedabad.

12th April:-Received my Passport.

Good Luck sandeepiitm....I am sure you will get passports back soon with stamps!

Submitted passports for all. (me, wife and daughter)
VFS made separate envelope for each putting I797, passport and email copy from Mumbai.
They did not take 221g copy and when asked they said its not required.

Just praying hard to get proper stamping soon.

Waiting since Dec 2011

Lot of cases from December 2011 are getting cleared! Is anyone still waiting since December 2011? I am in the waiting game since December 13!

Is it possible to hire a lawyer to send a show cause notice to the US consulate at Mumbai for such a long delay and also to ask for transparency in the 221g processing, may be by invoking the right to information act, to find out why is it taking so long for processing?

Also, is it possible to file a suit for damages incurred (rent, insurance, no pay, etc.) due to their delay in processing and refusal to give the status of visa processing which prevents us from proper financial planning.

Let me know if anybody have any comments or experiences or suggestions.

I would say roughly about 5-6 business days and provided they don't ask for additional documents.

What kind of a response do you get when you email the Consulate? Have you tried calling the Department of State and explaining that it's been a while? Maybe you could try contacting your local senator. Lastly, have you considered having a new petition filed, possibly with a different employer?

Passport recieved with VISA stamp..Quick turnaround

This is regarding my wife's H4 visa.
First appeared for H4 visa in Delhi (Mumbai consulate was closed and hence went to Delhi) (may 2011) when I was in EVC model. Was given 221(g) green and after documents submission, her visa was denied and my petiton was sent to USCIS for review.

Dec. 2011 I joined my client directly, and wife reappeared for h4 visa (Mumbai consulate, Jan 2012) and was given 221(g) blue after asking her about what happened in delhi interview.
Submitted 221(g) documents to VFS mumbai on Feb 22, 2012 and today receieved email saying:
Greetings from the Nonimmigrant Visa Section of U.S. Consulate General Mumbai.

Please follow the instructions below in order to continue processing your pending visa application further.

We are ready for final processing. Please submit your passport, pending letter and the courier envelope to the Consulate General via any of the VFS offices. Please carry a copy of this email for ready reference.

Please note that this email communication does not confirm that your visa is issued at this time.

I don't know if we should celebrate yet. We got married in Feb 2011 and were seperated since then. Let's see what happens next.

My wife submitted her passport to VFS Mumbai on Tuesday April 10th, and we got the passport back on April 12th.
Please note I did not sent any email to vfs helpline to check status of her H4 case after submitting documents on 22nd Feb. I guess one shoud wait atleast 8 weeks before doing any communication on their case.

How USCIS/consulate did verification on your company??? I mean did they send the officers to your employer's office?? or e mail??? In my case employer verification done by USCIS officers at my office 5-6 weeks ago, haven't heard anything after that.. so was just curious to determine the timeline after verification is done..!!! your reply is appreciated..!!!!

2 persons came and did verification(took project demo, verified HR related docs, took team pics and company photos) on 15th March 2012.
