H1 on additional processing due to client managed project

    Hi Shervin,

    First of all thanks for all your support during this ridiculous H1B Re Stamping process. Just to give an recent background of my case.

    Dec-7 -- Got VFS E-Mail confirming that my case sent back to USCIS for further review.

    Dec-20 -- As per USCIS Web-Site Case received by USCIS.

    Yesterday evening got below email-

    Please note that you are requested to submit your local Indian address at the nearest VFS centre for further processing.

    Kindly log on to the given link in order to check the nearest VFS center https://www.immihelp.com/usa-visas/u...ers-india.html
    VFS Centre Timings: - 8:00am to 1:00pm and 2:00pm to 3:00pm (Monday to Friday).

    NOTE: You need to carry the hard copy of this email for your reference.
    Also you need to pay Rs180/- in cash (VFS Service Charges) while submission of passport/Documents at the respective VFS centers.

    I am not sure what does it mean? Can i assume that USCIS sent the application back to consulate and get excited about the email that i received yesterday? Do i need to go in person to VFS Center as mentioned in email?

    Since VFS is not open for next few days, it really is confusing.

      I guess so. Yes, you need to go in person. Hopefully your visa is approved. Otherwise they wouldn't ask you to pay the fee.

          I called VFS today to confirm if they need me to submit Passports as well and i was told that they just need my local address and VFS service fee. As per the VFS person my case is still on hold from USCIS. It really is frustrating.

            Options beyond petition sent back to USCIS

            First of all thanks to all the gurus for your timely response on this forum and wish you a very happy new year.

            I am planning to go for new H1B as my current H1B petition has been sent back to USCIS for further review and possible revocation. I have spent 5 years and 1 month on current H1B. I have few questions regarding my current situation:

            1) Since i have my I-140 approved with current employer, would i be able to get my H1 extended beyond 11 months based on this approval?

            2) If i need to go with new H1B with another employer do i need to revoke my current H1 which is sent to USCIS for further review?

            3) If my priority date( EB2- July-2009) becomes current, before my H1B stamping, then what would happen to my Green Card petition?

            4) Based on multiple discussions, it seems there are high chances that my priority date would become current. So what are my options to expediate my Green Card process from India?

            5) If i go for new H1B with another employer and they would start my GC process using old priority date, what would happen if my priority date with old employer becomes current before my new Labor/I-140 gets approved?
