  • Question on H-1B stamping/congressman letter

    One of my friends employed by Company A working for a client Z since 2 years, went to india for a visit , appeared for h1 visa stamping interview in Hyderabad through Company A, was given 221(g), and finally his visa was rejected after 4 months. Reason being, Company A isnt doing well with IRS taxes etc, and couldn’t provide requested additional documentation, so it is entirely the company's fault for getting his visa rejected.

    Now Company B (Direct vendor to Client Z) came forward and sponsored his H1B visa, got his petition approved and his is yet to appear for the visa interview . My friend has been continuing to work for the client remotely without any break till date.

    For the upcoming visa interview, would requesting a letter of recommendation from Congressman of the same state where Company B is, help his probability of getting his visa approved? Please advise.

    >>> The consulate won't encourage these kind of recommendations. They will follow whatever the process that they need to do irrespective of whatever letter that is provided by a Congressman. These days the VO are held responsible for anything that goes wrong by a person who is on a visa.

    The previous rejection will not have any impact on the new visa stamping since the reason for rejection is the employer.
