  • H1B - Client & Work Location changes

    Hi,

My first time H1B petition got approved and visa stamping is also done. As per petition my client is ABC in location XYZ. Now things got changed and I’m going to work for some other client at some other location.

    1) Should I get new LCA & H1B Amendment done before I enter US?, My employer says they will do it once I come to US.

    2) If enter with old i129 & LCA, will it create problems in POE (new client location)?

    3) If I enter US with out new LCA & amendment, can I start working while LCA & amendment are being filed / in progress?

    Thanks

    1) Should I get new LCA & H1B Amendment done before I enter US?, My employer says they will do it once I come to US.
    >>> As per H1b regulations, you should get them amended. Entering U.S with a wrong approval notice is illegal. if caught, you can be in big trouble.

    2) If enter with old i129 & LCA, will it create problems in POE (new client location)?
    >>> If they figure out that you do not work for that client and the work location specified in your LCA, then they can even deport you back.

    3) If I enter US with out new LCA & amendment, can I start working while LCA & amendment are being filed / in progress?
    >>> You can start working as long as the H1B amendment is filed. H1B amendment cannot be filed without a valid LCA for the new work location. LCA will take about 10 days.
