  • No Marriage Certificate H4 Visa

    Hi,

I am planning to visit India for Marriage.
I do not have time for Marriage certificate.

Is it required to have Marriage Certificate to apply for H4 visa.
Has anyone any experience to get H4 visa without marriage certificate,
using photo or any other proof for Marriage?

    Thanks,
    Deep

Marriage certificate is very important to get H4. Without that, there is no proof that you are legally married. It will hardly take a couple of days to get the marriage certificate if you plan properly.
Not a legal advice. Use of this information is strictly at your own risk.

The consular officer may or may not ask for any proof of marriage, they may even accept other proofs of marriage such as invitations cards, wedding album etc. But that is subjective.
It is highly recommended that you get the certificate or at least complete your part of the process while you are there. Marriage certificate will be needed for other things like ITIN, H4 extensions etc.
This is my opinion and not legal advice.

Thanks for the reply, the problem is that in Himachal Pradesh, where I live and wedding will be
the Registrar will not give marriage certificate without a 30 days notice. Even though it is
usually not required for Hindu Marriage, they just declined to give the Certificate before 30 days.

The only think is the notorized affidavit or any other form of proof like letter wedding invitation,
        photos etc.

What is the opinion on trying to apply for H4 with all these, because we will get the
certificate anyways after 30 days of marriage. Espesially, will it hurt future chances of applying
with certificate which can be done after 30 days.

Well, you can certainly give it a try. I know cases where the VO has issued 221g for the marriage certficate.

Get the form on which notice is posted. Sign it and send it to your home, get your fiance/fiancee to sign it, complete the form and post with the registrar. Then whenever you go to India, after 30 days of notice, get married in front of the registrar and get the certificate. Don't mention Visa, passport or any such thing to them. It is possible that sensing your urgency they will delay the process hoping for some bribe to speed it up.
This is my opinion and not legal advice.
