  • Can I stamp my H1 in US embassy in Canada?

    Hi.
    I'm a physician on J1. I'm considering a waiver job. my question is the following:
    If I get a waiver job and an H1 status, will I be able to go to Canada to stamp my H1 so I can re-enter USA even if I don't have the H1 stamp and I go back to my country only if I get the H1 stamp. The reason I'm asking is that in the past my clearance took 2 months when I applied for J1 in my country. I'm scared of going to my country and being unable to come back.

    You can go to Canada for stamping. However, if the H1B visa gets denied in Canada, then you cannot enter U.S in H1B status.

      Any way that enables me not to leave the USA unless I know I'll be able to re-enter?

          In the past I visited my country and had to reaply for my J1 in the embassy. My clearance took 60 days.

          I'm wondering if there is a way I can guarantee I'll be able to re-enter the USA without delay if I have H1 job.

            There is no such guarantee. If they need to do the admin processing again, then will once again issue you a 221g.
