  • Blue slip designation different on client letter

    consulate issued 221g.and asked for client letter. My actual designation is prog. Analyst. However on client letter it is senior prog analyst. Shd i submit letter? Note that in interview i told vo.that i m working as senior prog analyst. Plz suggest if i shd submit letter or nt?

      Programmer Analyst / Senior programmer analyst falls under the same category and there isn't any difference in the job responsibilities. So it should be fine. However, since you already received a 221g for client letter, it is advisable to submit the client letter with the information matching your petition to avoid even 1% of risk (if any). If you have time, get the letter with Programmer Analyst as the designaton and submit that. If you don't have time, then go ahead with the current one.

        Thanks Shervin. I got 221G asking for more project details and client letter. My petition is filed for SFO , Programmer Analyst and client is now ready to give letter for Oakland,CA for some different project which is 16 miles away with the designation of Sr. Programmer Analyst. . If I submit the letter what are the chances of the approval?

          No one can predict. But since you have all the required documents, you should be fine. The distance between Oakland and SFO is very less and there is no need for a new LCA.

            Thanks Shervin. You always guide us in our H1b journey.

            I have one more query:
            My manager location in SOW is SFO and my location is Oakland. So will it create problem as there is concept of "Employer-Employee" relationship?

            Also, just want to know if consulate cross check the client letter with the client?

              >>> I don't think it will be a problem. It all depends on how you explain your case. If you work at both the locations, then you can explain that. 16 miles is a short distance for you to travel to meet your manager and for other meetings and you can explain the same.

                hey shervin, just an additional query since i have to help someone in their L1 petition...for L1's we never file a client letter, at most a MSA for the proposed project...is the client letter piece applicable only for H1's ? In fact many of our projects are fixed bid (Large MNC, 1lac+ employees) so many times client does not care who we staff at onsite since we are responsible for delivery quality

                  Irrespective of whether you are working on L1 or H1B, the client letter is required if you are working / reporting to someone at the client side. L1 is an intra company transfer. So in most cases the candidate will be moved to the onsite work location of the same company and will be reporting to manager within the same company. In such case a client letter is not required. If that is not the case and if the candidate will be working directly with the client, then a client letter is required. When you are in H1B and if your company is a consulting firm and if you are deployed at the client location for work, then a client letter is needed.

                    Shervin if I understood you right - you are saying even if the employee on L1 is working at the client site (but does not report to the client, works as part of the company's team and reports to the company manager, might even be part of the fixed bid team) the client letter is required ?
