  • I-94 Number mismatch

    I am in the country since 2009 and recently got my H1 Extn done. when i verified the document i noticed that the I-94 number is a new one and does not match with my old one. Will that pose a problem or should i get in touch with USCIS to get this corrected to reflect the old number.
    Will this effect your stay in USA and other related like Driver;s license and Car Tag.

    It should not be a problem. As long as you received a valid I-94 with yuor approval notice, you are good.

      Thanks for the information. But if you did not cross the country since 2009, even after a H1 transfer or H1 extension you should be getting the same I-94 number with a new expiry date. Last week i had been to the DMV to get my DL and CAR tag renewed and they objected because of this.
      Do i have to continue with the new I-94 # or get any confirmation from USCIS that i am good with the new number and the old one is obsolete.

        Usually USCIS will issue an I-94 with the same number. But there are cases where they generate a new number and not sure when/why that happens. But this should not be a concern to DMV. All that they should look into in your latest approval notice and the valid I-94 attached to it. Whether the I-94 is of the same number or a new one or whether you got the I-94 at the POE or by renewing the petition should not be their concern.

        If you want, you can check with USCIS or go to the nearby CBP posts and verify with an officer. You can also try renewing your driving license at a different DMV and it will work. Recently one of my friend went for the driving license renewal with an extended petition and I-94 and the person at the DMV was arguing that there should be a stamp in the I-94. We tried convincing the DMV employee that there will be a stamp only when we get an I-94 at the POE and not when we get a renewal. But she didn’t buy it. So my friend had to go to a different DMV to get the license renewed.

          Once again thank you for the information.

          1. I moved from one state to other and i have to get my DL and Car Tag transferred and when my I-94 details were verified , the DMV guys told me that my immigration details are not verifiable at this point because of the mismatch. i believe that the immigration database which DMV access is stil showing my old I-94 # which expired. Can i try once again in a different DMV as suggested by you?

          2. Given the above scenario of improper updation of I-94 #, if i have to travel out of country - i will have to surrender the current I-94 and once again there will be a conflict when i get to POE . How do i overcome this situation.

            >>> Yes, try it in a different DMV and probably the information would have got updated now. If there is still an issue, talk to USCIS or go to the nearby CBP post and ask them to validate your I-94 number that is issued to you.

            >>> You always get a new I-94 (new number) at the POE when you re-enter. This is not an issue. However, the I-94 number that they issued you with the extended approval notice should be in their system against your name. If not, that is a problem. If the new information is not there, then with the old I-94 already expired, it will show as if your current stay is illegal.
