urgent help plz suggest

my visa interview was done about 4 weeks ago.
my I129, lca, employer letter, vendor letter, I797 approval form was taken. Passport was not taken.
i was not given any slip. VO said uscis will contact my employer.

i was waiting for them. Is there any way i can transfer my H1 to a different employer and go for stamping again.
is it possible if i am in india and transfer my h1b to a different employer?

Yes, another employer can file a cap-exempt petition for you. After it is approved, you can apply for the Visa.

what about cap

Does the cap needs to be open. one of my friends attorney said the cap need to be open to transfer my h1b. is it true? . Right now the cap is close for the fiscal year 2012. so they said its not possible to transfer since i am in india. is it true.
Please suggest me .

Cap-exempt = Exempt from cap. Cap doesn't have to be open.
