h1B to h4 change of status

Hi,

I am currently on h1b visa, however I lost my job (15th december 2011).

I have India trip planned shortly, which I can not cancel. So I have very little time to find a new job and get h1b transferred to new employer.

My husband is on valid h1b. I was thinking of going to India and apply for h4. Does anyone know if there is any risk involved in this H1B to H4 change of status? What kind of questions would I be asked?

As long as your husband is in valid H1B status you will be able to get the H4 stamped, provided you carry all the required documents. Make sure you leave the country as soon as possible to avoid accumulating more out of status period in H1B. If you cannot leave immediately, then file the COS from H1B to H4.
