  • H-1B & OPT extension

    I have some questions regarding my H-1B status. I was on H-1B with a company on full time basis. I was laid off on 3rd Jan 2012 and soon will be out of status. My first 12 months of OPT expired on 2nd Jan 2012, but I could not apply for OPT extension since my status changed to H1-B.
    Am I still eligible for applying for OPT extension if I have job offer from e-verified company?
    If I get Job after H-1B is revoked. Can I still transfer my H-1B?

    You are not eligible for OPT extension since you already got your H1B approved. H1B transfer need to be filed before your last day on the job. Any time after the terminantion will be considered as out of status period and an H1B transfer is not possible when you are out of status. You will need to submit the latest payslips for a successful transfer. Without that either the transfer will get denied or will get approved for consular process (without a new I-94). So, it is advisable to file the transfer as soon as possible.
