can we try for any other visa while H1b is under admin processing?

Hi shervin and All,

My H1b petition has been sent to USCIS for review in Nov 2010. My employer now wants me to go for B1 visa and he say he will provide all the documents neccessary. He said once i get the notification about H1b petition re-affirmed from USCIS, i can come back to india and get my h1b stamped. Is this possible?

Can i try this? what are the chances of getting B1 approved when h1b petition is under admin processing.

You can apply and get the B1 as long as you can prove to the VO that the intention for travel in B1 is purely for business or meetings. You are not allowed to work in B1 visa and if you do that it is illegal. OPtherwise, you are allowed to apply for a different visa category when one is under admin processing.

I was a key resource for a big project at my client place, they are unable to continue the project without me, so my employer wants me to go there and train a couple of people to handle that project. will this be a valid reason for B1?

Yes. Get a letter that mentions that you are going for training and that will help.
