H1 and L2 combination

Hi,

My 6 years on my H1 is expiring this April. My spouse is working on a L1 visa. I am planning to continue working after getting a L2 visa. Can I apply for a new H1 (or) L1, 365 days after my old H1 expired even though I may be in US on a L2 all along or is it that for a new H1 or an L1 I have to be physically out of the country for 365 days?

You have to physically stay out of U.S for 1 whole year to get a fresh H1B or L1.
