H1B Regular -> RFE -> Premium Processing -> ???

Hi,

My H1B was filed under regular processing with USCIS in September last year. After receiving no response for so long, we decided to upgrade it to premium and sent the necessary forms.

Then on 30th Jan, the USCIS site showed the status as RFE. But by then we had already sent the PP upgrade forms to USCIS. On 2nd Feb the site showed that they have received the application for premium processing. Now the status has gone back to Acceptance as of 3rd Feb. We still don't know what the RFE is.

What is going to happen now after 15 days? Another RFE? Is there a slim chance of approval? Or will they keep waiting for the response to the RFE they already sent before processing anything?

Any pointers much appreciated.

If an RFE was already sent, then they will wait until they get the response back to continue the process. Since you have upgraded your case to premium, it will take 15 days from the date of receiving your doucments to get a result on your H1B extension. Check with the lawyer/employer to see if they received the RFE. If not, ask them to take an infopass appointment with USCIS to discuss your case.
