h1b visa rejected

trying to get H4 visa. can I use the same I797 from my refused h1b again after getting a job in US? it is valid for three years

If you enter U.S in H4 status, you cannot work. However, any employer can file COS from H4 to H1B using the CAP from your previous H1B approval notice and request an immediate start date. If the COS gets approved (approved I-797 should come with a new I-94), then you should start working as of the H1B effective date.
